Description please read original post and then respond to edward with 200 words original post Both employers and employees have a right to contest citations and penalties and to request a review of decisions made by administrative law judges by the full Occupational Safety and Health Review Commission (OSHRC). The process is used frequently by employers but infrequently by employees. Reflect on situations where you believe an employee would benefit the most from contesting a citation. As you respond to your classmates’ posts, discuss why you believe employees do not participate in the process to a greater extent. edwards post Good evening, I think the employee is in prime position to contest a citation or penalty. The employee has first hand knowledge of daily operations and work practices because he/ she is actually in the field doing the work. The OSHA inspector may not see the full picture during the inspection and although a write-up may seem appropriate, the employee may know otherwise due to their duty position within daily operations. In this case, the employee can provide strong evidence as to why the write-up was not justified or if the abatement period is unreasonable. I believe employees don’t participate in the process as much because they aren’t fully educated in the process of contesting a citation/penalty and are unaware of the steps required to properly appeal or contest a citation. They leave this type of negotiating to the employer.
